By accessing, interacting with, or using any component of the Services, you acknowledge that you have read, understood, and agree to be legally bound by the terms and conditions set forth herein. If you do not accept these terms, you must immediately discontinue use of the Services.

2. Scope of Application

This Policy applies to all individuals and entities interacting with Atlas National, including plan participants, clients, benefits brokers, vendors, employees, and other authorized users of our systems. It encompasses all personal information obtained directly or indirectly through the delivery of our Services, including through:

  • Benefits program enrollment, claims processing, and participant support
  • Regulatory compliance operations (e.g., ERISA, HIPAA, IRS Section 125, COBRA, ACA, New York Wage Parity Law)
  • Communication platforms, including secure portals, mobile apps, and SMS/text messaging programs

3. Categories of Information Collected

We collect and maintain the following categories of information:

A. Identifiable Personal Data
This includes but is not limited to:

  • Full name, date of birth, Social Security number
  • Residential address, email address, mobile phone number
  • Employment-related information including payroll and eligibility data
  • Dependent and beneficiary details

B. Plan and Claims Information

Information relating to eligibility,elections, reimbursements, claim submissions, and supporting documentation
asrequired under applicable plans.

C. Health Information (PHI)

Collected and maintained in compliancewith the Health Insurance Portability and Accountability Act (HIPAA) andassociated regulations.

D. Technical and Usage Data

Includes IP address, browser type,device identifiers, session metadata, app interaction data, and access logs.

E. Communication Records

Retention of chat transcripts, calllogs, support tickets, consent preferences, opt-ins/opt-outs, and feedbackcollected through any channel.

4. Purpose of Data Processing

Your data is processed for the following legitimate business and regulatory purposes:

  • Administration of health and welfare benefit plans, FSAs, HRAs, HSAs, and Commuter Benefits
  • Identity verification and participant authentication
  • Delivery of regulatory-compliant notices and disclosures
  • Payment processing and claims adjudication
  • Support ticket resolution and participant service delivery
  • Risk management, fraud prevention, audit preparation, and litigation response
  • Legal compliance and fulfillment of contractual obligations with your employer, plan sponsor, or broker

We do not use your data for profiling, targeted advertising, or unrelated marketing purposes without your express consent.

5. Data Retention and Storage

All personal and sensitive information is retained in accordance with applicable laws, industry standards, and contractual obligations. Retention periods are based on statutory requirements, audit trails, dispute resolution, and operational needs.

Data is stored on secure, access-controlled, and encrypted servers. When retention is no longer legally or operationally required, data is securely destroyed or anonymized.

6. Data Protection and Security Measures

Atlas National maintains a robust information security framework, incorporating physical, technical, and administrative safeguards that meet or exceed industry standards, including:

  • Role-based access control (RBAC) with least-privilege enforcement
  • End-to-end encryption of data at rest and in transit
  • Multi-factor authentication for system administrators and privileged accounts
  • Real-time security event monitoring and audit logging
  • Secure development lifecycle (SDLC) practices for all software platforms
  • Ongoing penetration testing and vulnerability management
  • Third-party vendor risk assessments aligned with SOC 2 and HIPAA standards

7. Data Sharing and Third Parties

We do not sell or rent any personal data under any circumstances.

Disclosures of data are limited and made only as required to fulfill our contractual or legal obligations, including:

  • Trusted vendors (e.g., benefits card issuers, custodians, cloud infrastructure providers, SMS platforms), strictly bound by confidentiality and use limitations
  • Plan sponsors, brokers, and compliance auditors subject to fiduciary standards
  • Government agencies and legal authorities pursuant to subpoenas, court orders, or regulatory inquiries

8. Your Rights

Depending on your jurisdiction, you may have the right to:

  • Access your data and request a copy
  • Request corrections to inaccurate or incomplete data
  • Withdraw consent (including SMS, email, and promotional communications)
  • Request deletion, where permitted under law
  • File a complaint with a regulatory authority regarding our handling of your personal data

9. SMS/TEXT MESSAGING PROGRAM

A. Overview

Atlas National provides an optional SMS/Text Messaging Program for clients and participants to receive real-time, compliance-related, and service-related communications. Participation is strictly voluntary.

B. Information Collected

Upon opt-in, we collect:

  • Your mobile number
  • Communication metadata (timestamps, delivery/read status, opt-out status)

We do not collect content beyond that required to fulfill service or compliance functions, and we do not share or sell mobile numbers or SMS consent information.

C. Use ofInformation

SMS data is used exclusively for:

  • Delivery of account updates, enrollment notifications, billing alerts, and benefit-related reminders
  • Regulatory compliance (e.g., Wage Parity documentation, audit trails)
  • Service security, consent recordkeeping, and fraud prevention

D. Third-PartyAccess

SMS delivery vendors and telecomcarriers are authorized solely to transmit messages on our behalf. No mobileopt-in data is disclosed to affiliates or external marketers.

E. UserControl & Opt-Out

To opt out, reply STOP at any time. Torequest support, reply HELP or contact

message and data rates may apply.

10. SMS TERMS OF SERVICE

1. Program Description

By opting into our SMS program, you consent to receive service-related, informational, and/or promotional messages, based on your selected categories at the time of consent.

2. MessageCategories

Conversational &Informational (default): Benefits updates, account status, compliance alerts,and client support.
Promotional (optional):Marketing and service announcements, only if registered and separatelyconsented.

3. Consent Mechanisms

Consent may be obtained via:
  
1. Online form with opt-incheckbox
2. In-service prompts duringsupport interactions
3. Verbal or written consent, asdocumented

4. Revocation of Consent

Opt-out via text by replying STOP toany message. For help, reply HELP or contact support. We will honor all opt-outrequests promptly and in accordance with law.

5. Data Handling and Compliance

SMS data is protected under the samestrict privacy and security controls as all other personal data we manage. Nomobile information is sold or transferred to unaffiliated third parties.

6. Program Modifications

We reserve the right to modify orterminate this program at any time. Material changes will be reflected with arevised “Last Updated” date.Last Updated: October 18, 2025

11. Terms of Use

A. Acceptable Use

You agree to use the Services solely for lawful purposes and in accordance with all applicable laws and regulations. You shall not:

1. Interfere with system operations or attempt unauthorized access
2. Misrepresent your identity or affiliation
3. Copy, distribute, reverse-engineer, or exploit any proprietary platform, code, or data
4. Use the Services to send unlawful or unauthorized messages

B. Reservation of Rights

Atlas National reserves all rights not expressly granted herein, including the right to suspend or terminate access to users who violate these terms or applicable law.

12. Governing Law and Jurisdiction

This Policy shall be governed by and construed under the laws of the State of New York, without regard to its conflict-of-law rules. All disputes arising under or in connection with this Policy shall be resolved exclusively in the federal or state courts located in New York County, New York.
